Mandatory Justice: The Death Penalty Revisited

Recommendations for addressing the deep flaws in the death penalty are presented and explained. Thirty-two recommendations are organized into the following eight areas: ensuring effective counsel; reserving capital punishment for the most heinous offenses and most culpable offenders; expanding and explaining life without parole (LWOP); safeguarding racial fairness; ensuring systems for proportionality review; protecting against wrongful convictions and sentences; duty of judge and role of jury; and role of prosecutors.
